Acceptance of Agreement

By submitting an application to the EnviroBiomics Affiliate Program, you acknowledge that you have read and agree to these Terms & Conditions.

Submission of an application does not guarantee acceptance into the Program. Participation begins only after EnviroBiomics approves your application.

Eligibility

Participants must be at least 18 years of age and legally capable of entering into this Agreement.

EnviroBiomics reserves the right to approve or reject any affiliate application at its discretion, consistent with applicable law.

Application & Approval

Applicants must provide accurate, complete, and current information when applying to the Program.

EnviroBiomics may review an applicant's website, social media presence, business activities, or other relevant information before approving participation.

Affiliate Account Information

Affiliates are responsible for maintaining accurate account, contact, payment, and business information.

Affiliates are also responsible for maintaining the confidentiality of their account credentials and for activity conducted through their account.

EnviroBiomics may request additional information reasonably necessary to administer the Program, verify an affiliate, process payments, or comply with applicable legal or tax requirements.

Affiliate Links & Tracking

Approved affiliates may receive unique tracking links, referral URLs, promotional codes, or other tracking methods made available through the EnviroBiomics affiliate platform.

Affiliates are responsible for using the tracking methods provided by EnviroBiomics correctly. Commissions can only be attributed where the applicable referral can be reliably tracked or otherwise verified.

Tracking may be affected by browser settings, cookie restrictions, privacy technologies, ad blockers, device changes, or other circumstances outside EnviroBiomics' reasonable control.

Commission Structure

Affiliates may earn commissions on eligible purchases properly attributed to their affiliate account.

Commission rates may vary by affiliate, product, campaign, promotion, or other Program terms. The applicable commission rate will be displayed within the affiliate account or otherwise communicated by EnviroBiomics.

Unless otherwise stated, commissions are calculated on qualifying product revenue after applicable discounts and exclude shipping, taxes, refunds, chargebacks, and other non-qualifying amounts.

Payment Terms

Affiliate payments are issued using the payment method supported by EnviroBiomics and subject to applicable payment thresholds, verification requirements, and processing schedules.

Affiliates are responsible for providing accurate payment information. EnviroBiomics is not responsible for payment delays caused by incorrect or incomplete information provided by the affiliate.

Refunds, Chargebacks & Commission Reversals

Commissions are not payable on refunded, cancelled, fraudulent, disputed, or otherwise invalid transactions.

If a commission has already been credited or paid for a transaction that is later refunded, charged back, cancelled, or determined to be fraudulent, EnviroBiomics may reverse or deduct the corresponding commission from future payments where permitted by applicable law.

Self-Referrals

Affiliates may not use their own affiliate links, promotional codes, accounts, or other referral mechanisms to earn commissions on their own purchases.

Attempts to circumvent this restriction through additional accounts or other artificial referral arrangements may result in cancellation of commissions or termination from the Program.

Affiliate Disclosure Requirements

Affiliates must clearly disclose their material relationship with EnviroBiomics whenever promoting EnviroBiomics products or services where required by applicable advertising or consumer protection law.

Disclosures should be clear, conspicuous, understandable to the intended audience, and placed near the endorsement, recommendation, or affiliate link when appropriate.

Affiliates are responsible for ensuring that their disclosures comply with applicable laws and platform-specific requirements.

Advertising & Promotional Rules

Affiliate promotions must be truthful, accurate, and not misleading. Affiliates may not make representations about EnviroBiomics products, services, pricing, performance, or capabilities that are false, deceptive, or unsupported.

Affiliates may not present themselves as EnviroBiomics employees, agents, authorized medical representatives, or official company accounts.

Intellectual Property & Brand Usage

EnviroBiomics trademarks, logos, product names, graphics, photographs, reports, website content, and marketing materials remain the property of EnviroBiomics or their respective owners.

Affiliates may use approved brand assets solely for legitimate promotion of EnviroBiomics products and services in accordance with applicable brand guidelines.

Affiliates may not modify EnviroBiomics branding in a misleading manner or create websites, domains, social profiles, advertisements, or materials that falsely appear to be owned or operated by EnviroBiomics.

Prohibited Activities

Affiliates may not engage in activities that could harm customers, EnviroBiomics, or the integrity of the Affiliate Program.

• False or misleading advertising
• Unsupported medical or health claims
• Fraudulent or artificial referrals
• Unauthorized use of EnviroBiomics branding
• Spam or unlawful electronic communications
• Impersonation of EnviroBiomics or its employees
• Cookie stuffing or deceptive tracking practices
• Manipulation of referrals or commissions
• Promotion through unlawful, deceptive, or inappropriate content

Privacy & Personal Information

Information collected in connection with the Affiliate Program will be handled in accordance with the EnviroBiomics Privacy Policy and applicable privacy laws.

Affiliates must also comply with applicable privacy and data protection requirements when collecting or processing personal information in connection with their promotional activities.

Taxes & Required Documentation

Affiliates are responsible for determining and satisfying their own tax obligations arising from commissions received through the Program.

EnviroBiomics may require affiliates to provide their legal name, mailing address, country of residence, tax information, payment information, or other documentation reasonably necessary to process payments or comply with applicable legal and tax requirements.

Monitoring & Compliance

EnviroBiomics may review affiliate promotional activities to help ensure compliance with this Agreement, applicable law, and Program policies.

EnviroBiomics may request that an affiliate correct, modify, or remove promotional content that violates Program requirements.

Affiliate Account Inactivity

Affiliate accounts that remain inactive for six (6) consecutive months may be automatically deactivated and removed from the EnviroBiomics Affiliate Program.

For purposes of this Program, an account may be considered inactive when no qualifying affiliate activity has been recorded during the six-month period.

Affiliates whose accounts have been deactivated due to inactivity may request reactivation by contacting EnviroBiomics through the available telephone or email support channels.

Suspension & Termination

Either party may end participation in the Affiliate Program subject to the terms of this Agreement.

EnviroBiomics may suspend or terminate an affiliate account for violations of these Terms, fraudulent activity, misleading advertising, unauthorized claims, abuse of the Program, or other conduct that materially harms the Program, customers, or the EnviroBiomics brand.

Upon termination, the affiliate must discontinue use of EnviroBiomics affiliate links and any brand assets for which authorization has ended.

Relationship of the Parties

Participation in the Affiliate Program does not create an employment, agency, partnership, joint venture, franchise, or representative relationship between the affiliate and EnviroBiomics.

Affiliates operate independently and have no authority to enter into agreements or make commitments on behalf of EnviroBiomics.

Disclaimer & Limitation of Liability

The Affiliate Program and related tracking systems are provided subject to applicable law and without any guarantee of uninterrupted availability, specific earnings, sales volume, or referral performance.

To the maximum extent permitted by applicable law, EnviroBiomics will not be liable for indirect, incidental, special, consequential, or similar damages arising from participation in the Program.

Indemnification

To the extent permitted by applicable law, affiliates are responsible for claims, losses, liabilities, or expenses resulting from their unlawful promotional activities, unauthorized representations, violations of this Agreement, or infringement of third-party rights.

Changes to the Program or Agreement

EnviroBiomics may update the Affiliate Program, commission structure, Program policies, or these Terms from time to time.

Material changes may be communicated through the affiliate dashboard, email, this page, or another reasonable method.

Continued participation after an updated Agreement becomes effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

Governing Law

This Agreement is governed by the laws specified by EnviroBiomics for the Affiliate Program, without regard to applicable conflict-of-law principles, subject to any rights that cannot legally be waived.

Any specific venue, jurisdiction, or dispute resolution requirements applicable to the Program will form part of this Agreement.
